Terms of Service

These terms are an agreement between you and Mtihani Space, Nairobi, Kenya. By creating an account you accept them. Please also read our Privacy Policy.

1. The service

Mtihani Space gives learners in Grades 4–12 revision questions aligned to Kenya's Competency Based Curriculum, marks their answers with feedback, and reports progress to parents. Marking is produced by an AI model following CBC rubrics. It is a study aid, not an official assessment: it can make mistakes, and it does not replace a teacher or KNEC grading. Where it matters, check with your child's teacher.

2. Accounts and children

You must be a parent or guardian aged 18 or over to create an account. You create the learner profiles for your children and are responsible for how they use the service and for keeping your password and any learner PIN safe. Each learner profile is for one child.

3. Free trial, plans and payment

  • New accounts get a free trial (currently 3 days, with AI marking capped per day). You can extend it with the small Trial Boost shown in the app.
  • After the trial, marking requires a plan. Plans are per learner: each child needs their own. Prices, daily marking limits and durations are shown on the pricing page and in the app before you pay.
  • Payment is by M-Pesa. A plan starts when Safaricom confirms payment and runs for its stated period. Plans do not auto-renew; we will remind you before one ends.
  • If a payment fails or is reversed, the plan is not activated. If you are charged and the plan does not activate within an hour, email us with the M-Pesa reference and we will fix it or refund you.
  • Refunds: if the service is unavailable for more than 24 hours during a paid plan, we extend the plan by that time. We do not refund for a child not using the service. Prices may change; a change never affects a plan already paid for.

4. Fair use

Daily marking limits exist so that the service stays fast and affordable for everyone. Do not share an account across families, use automated tools against the service, or try to extract the question bank. Questions, model answers and feedback are ours or our licensors' and are for your family's personal study only.

5. Content you submit

Answers, photographs of working, ratings and comments you or your child submit remain yours. You give us permission to process them to provide the service, to review markings, and to improve our questions and marking. We may show praise you give us (first name and grade only) on our website; tell us if you would rather we did not.

6. Teachers and referrals

Teachers and other partners may share referral links. Referral rewards are paid as shown in the referral programme at the time and may be withheld for self-referrals, fake accounts or abuse.

7. Messages

We send account messages by email and WhatsApp. Reminders and progress updates are optional; you can stop them from the app, by the unsubscribe link in an email, or by replying STOP on WhatsApp.

8. Availability and liability

We work to keep the service available and the marking accurate but cannot promise either will be perfect. To the extent Kenyan law allows, our liability to you is limited to the amount you paid us in the three months before the claim. Nothing here limits rights you have under the Consumer Protection Act that cannot be excluded.

9. Ending the agreement

You can delete your account at any time by emailing us. We may suspend or close accounts that break these terms. On closure we handle your data as described in the Privacy Policy.

10. Changes and law

We may update these terms; material changes will be emailed to account holders. These terms are governed by the laws of Kenya, and disputes are subject to the courts of Kenya.
